Sandra Müller-Thomczik: Steuervermeidung von Großkonzernen



Gegenstand des vorliegenden Beitrages ist die Analyse des komplexen Verantwortungsgefüges der Steuervermeidung von Großunternehmen im Spannungsfeld von Legalität und ethischer Verantwortung. Der Fokus liegt auf gewinnverlagernden Konstruktionen mittels Lizenzvereinbarungen, die anhand des „Double Irish with a Dutch Sandwich“ zunächst beispielhaft erläutert werden. Die daran anschließende Analyse des Verantwortungsgefüges erfolgt anhand eines relationalen Verantwortungsbegriffs, welche die möglichen Subjekte und Objekte moralischer Verantwortung auf Unternehmens-, Ordnungs- und Individualebene untersucht. Die Heranziehung einer Verantwortungsinstanz in christlich-biblischer Betrachtungsperspektive führt zu dem Schluss, dass die Verknüpfung von Steuerzahlung und explizit aktiver wirtschaftlicher Tätigkeit Teil unternehmerischer Verantwortung ist. Die Aushebelung des Äquivalenzprinzips verbunden mit den Besonderheiten der Internationalität bedingen ein potentielles Risiko für die Sozialstaatlichkeit und damit für den schützenswerten „Nächsten“ als Priorität.

This paper analyses complex responsibility structures with regard to avoiding tax payments of large-scale enterprises. This tax avoidance is based on constructions of profit shifting by license agreements. This strategy is explained by a description of the “Double Irish with a Dutch Sandwich” as an example for tax-avoiding constructions. Based on a relational term of responsibility the following analysis reveals the possible morally-responsible subjects and objects on the company, systematic and individual level. By using a responsibility authority considered from a Christian biblical perspective the author comes to the conclusion that the connection of tax payments and explicitly active economical behavior are part of corporate responsibility. Leveraging the principle of equivalence determines a risk for the welfare state and thereby for the worth protecting “neighbor” as priority. The lack of the state’s scope coming with the international side emphasizes this result.
